Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Retrollect website at retrollect.com and our mobile applications (collectively, the "Service"), operated by Synsi ("we", "us", or "our"), registered in the Netherlands.

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately. These Terms should be read alongside our Privacy Policy, which explains how we collect and use your personal data.

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.

If you are between 13 and 16 years of age and located in a country where the GDPR applies, you represent that you have obtained verifiable parental or guardian consent where required by applicable law.

We reserve the right to terminate accounts of users who do not meet the minimum age requirement.

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and not share it with others.
• Notify us immediately at hello@retrollect.com if you suspect unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with or without prior notice.

You agree to use the Service only for lawful purposes. You must not:

• Post false, misleading, or inaccurate catalogue data or content.
• Harass, threaten, or harm other users.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Scrape, crawl, or systematically extract data from the Service without prior written permission.
• Use the Service to transmit spam, malware, or any harmful code.
• Impersonate another person or entity.
• Circumvent, disable, or interfere with security-related features of the Service.
• Use the Service in any way that violates applicable local, national, or international law.

We reserve the right to remove any content that violates these rules and to suspend or terminate the accounts responsible.

Retrollect allows users to submit content, including package data, hardware entries, catalogue proposals, articles, comments, and other contributions ("Submissions").

By submitting content to the Service, you irrevocably assign to Synsi all rights, title, and interest in and to that content, including all intellectual property rights, worldwide and in perpetuity. This assignment takes effect upon submission, without further action required from either party.

You represent and warrant that:

• You have the right to submit the content and to make this assignment.
• Your Submissions do not infringe the intellectual property, privacy, or other rights of any third party.
• Your Submissions are accurate to the best of your knowledge.

We are not obligated to display, retain, or act on any Submission and may edit, remove, or reject content at our discretion.

All content on the Service that is not user-submitted — including the Retrollect name, logo, design, software, text, and graphics — is the exclusive property of Synsi and is protected by applicable intellectual property law.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

The Service uses third-party services including Google Analytics for anonymised usage measurement. Your use of the Service is also subject to the terms and privacy policies of those third parties.

We are not responsible for the content, policies, or practices of any third-party services linked to or integrated with Retrollect.

The Service is provided "as is" and "as available", without warranty of any kind — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Catalogue data is community-contributed and may contain errors; we make no guarantee as to its completeness or accuracy.

To the fullest extent permitted by Dutch law, Synsi and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising from or in connection with your use of, or inability to use, the Service.

In any case, our total liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the greater of €50 or the total fees you have paid to us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities; in such cases, the above limitations apply to the maximum extent permitted by law.

You agree to indemnify and hold harmless Synsi and its directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your Submissions, or your violation of these Terms.

You may delete your account at any time through your account settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Sections 5 (User-Submitted Content), 6 (Intellectual Property), 8–10, and 12 survive any termination of these Terms.

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.

If you are a consumer resident in the EU, you also have the right to submit a complaint to the Online Dispute Resolution platform operated by the European Commission.

We may update these Terms from time to time. We will give registered users reasonable notice of material changes via email or an in-app notice before the changes take effect. Continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms.
